Terms of Use

These Terms govern your use of PauseDeck, provided by Here Within, Inc. (“we,” “our,” or “us”). By accepting these Terms, you agree to them. If you do not agree, do not use the app. PauseDeck is for adults 18 and older. By using it you confirm that you are at least 18.

The short version

  • PauseDeck is a self-guided wellbeing tool, not medical care or an emergency service.
  • Ten cards are free. One purchase through Apple unlocks the rest. No subscription.
  • We keep nothing about you. Disputes are handled under California law, in San Francisco or small-claims court.

1. Wellbeing support, not medical care

PauseDeck offers self-guided activities for general wellbeing. It does not provide medical advice, diagnosis, psychotherapy, or treatment. Using it does not create a clinician-patient relationship, and no particular outcome is guaranteed.

Do not disregard professional advice or delay care because of the app. Choose practices that suit your abilities and circumstances, and stop if a practice causes discomfort. Do not use the app while driving or doing something that requires your full attention.

PauseDeck does not monitor emergencies. For immediate danger or a medical emergency, call your local emergency number. In the United States, call or text 988 for suicide or mental health crisis support. Our support inbox is not an emergency service.

2. Free access and purchases

PauseDeck includes 10 free cards. An optional one-time purchase unlocks all 50 cards and favorites. The price appears before you confirm payment. There is no subscription or automatic renewal.

Apple processes payment under its applicable terms. Use Restore purchases with the Apple Account used for the original purchase to restore an eligible unlock. For refund requests, visit reportaproblem.apple.com. Applicable consumer rights remain unaffected.

The purchase covers the features described at purchase; it does not guarantee indefinite software support or compatibility with every future device or operating system.

3. Your writing

Writing is temporary and clears when you leave the card or the app process ends. Favorites do not save responses. We cannot recover cleared writing. You retain any rights you have in your own text. The Privacy Policy explains local storage.

4. License and intellectual property

You may use PauseDeck for personal, noncommercial purposes under Apple’s Standard End User License Agreement. These Terms supplement that agreement and do not replace the software license. The Standard EULA controls any conflict concerning the license, subject to applicable law.

The app’s software, designs, images, and protected content belong to Here Within, Inc. or its licensors. You may not commercially redistribute protected content, bypass purchase restrictions, or interfere with the app’s operation, except as permitted by law.

If you send us suggestions or feedback, we may use them to improve the app without any obligation to you.

5. Warranties and liability

To the extent permitted by law, PauseDeck is provided “as is” and “as available,” without warranties of uninterrupted availability, error-free operation, or fitness for a particular purpose.

To the extent permitted by law, Here Within, Inc. is not liable for indirect, incidental, special, or consequential damages arising from use of the app. Nothing in these Terms excludes liability or limits warranties, refunds, or consumer rights that cannot legally be excluded or limited.

6. Disputes and governing law

If you have a problem, email support@hellopausedeck.com first and we will try to sort it out. These Terms are governed by California law and applicable United States federal law, without limiting consumer-protection rights of the state where you live that cannot be waived. Any dispute that we cannot resolve must be brought in the state or federal courts in San Francisco County, California, unless the law requires another forum; either of us may instead use small-claims court. To the extent the law allows, our total liability for all claims related to the app will not exceed the greater of what you paid for the app or US $100, and any claim must be filed within one year after it arises.

7. Changes to these Terms

We may update these Terms as the app changes. We will post the new version at hellopausedeck.com/terms and update the date, and the app will ask you to agree again where the law requires it. Changes will not retroactively remove your accrued rights.

8. California residents

Under California Civil Code section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
